1. Scope of the General Terms and Conditions and Details of the Service Provider

1.1. These General Terms and Conditions (hereinafter: GTC) apply to the airport parking and transfer service (hereinafter collectively: Service) provided by S&M Parking Kft (registered office: [4300 Nyírbátor Zrínyi utca 14 3/8], tax number: 33055868-2-15, company registration number: 15 09 094672, telephone: +36 70 744 7772, e-mail: info@nullterminal.hu, web: https://www.nullterminal.hu/, hereinafter: Operator).

1.2. By submitting a booking, ordering the Service, or physically entering the parking area, the person ordering or actually using the Service (hereinafter: Passenger) expressly acknowledges, accepts, and agrees to be bound by the provisions of these GTC. The GTC are continuously available and may be reviewed on the Operator's website and at the on-site customer service desk.

1.3. The Operator declares that, beyond the statutory requirements and the expectations customary in the sector, these GTC do not contain any unreasonably disadvantageous or unusual conditions for the Passenger.

1.4. If the Operator and the Passenger (or a legal entity acting on behalf of the Passenger) enter into a separate written agreement, the provisions of these GTC shall remain applicable to matters not regulated in the separate agreement.

2. Description and Nature of the Service

2.1. The Service provided by the Operator consists of two main elements: the secure storage of motor vehicles (in an outdoor parking area or enclosed garage), and the transfer of Passengers and their luggage between Budapest Ferenc Liszt International Airport (Terminals 2A and 2B) and the Parking Facility.

2.2. Parking types:

  • Outdoor gravel parking area: An enclosed outdoor area protected by fencing and monitored by cameras.
  • Enclosed, covered, cooled and heated garage: A premium parking option with complete protection from the weather and a controlled indoor temperature, available by separate order.

2.3. Free and inseparable transfer: The airport transfer is an integral and included part of the basic parking price, and no separate surcharge is charged for it. If the Passenger chooses not to use the transfer service, this does not entitle the Passenger to a reduction in the parking fee.

2.4. Discounted night-time period: The Operator does not charge an additional parking day for Passengers whose departing flight requires them to arrive at the parking facility after 22:00, or whose returning flight lands at the airport before 03:00 and who leave the parking facility before that time.

2.5. Refusal of the Service: The Operator declares that it is under no obligation to enter into a contract. The driver or the on-site staff are entitled to refuse passenger transport or entry to the parking facility, or to exclude the Passenger from transport, if the Passenger:

  • Is intoxicated, under the influence of drugs, or behaves in a scandalous or aggressive manner;
  • Endangers traffic safety, the physical safety of staff or fellow passengers, or the integrity of vehicles and equipment through their conduct;
  • May soil the transfer vehicle with contaminated clothing or luggage;
  • Is unable to travel without assistance, is incapacitated, or is a minor under the age of 6 travelling without an accompanying adult.

3. Booking, Payment and Barion Online Bank Card Payment

3.1. The Service may be booked through the Operator's online platform, by telephone, or on site. The booking becomes final upon confirmation. The Passenger may request changes to the data free of charge before the start of the journey.

3.2. Payment Methods and Online Bank Card Payment (Barion)

The fee for the Service may be paid on site in cash/by bank card, or in advance through the website using secure online bank card payment.

Online payment: Online bank card payments are provided by Barion Payment Zrt. (E-money licence number: H-EN-I-1064/2013). Null Terminál Airport Parking does not process or store bank card data and has no access to such data in any form; such data are handled exclusively by the secure system of the payment service provider (Barion).

4. Use of the Service and the Parking Facility

4.1. Booking and modification: The Service may be booked through the Operator's website, by telephone, or on site. The order becomes final upon confirmation. Before the start of the journey, the Passenger is entitled to modify the booking details (e.g. registration number, dates and times) flexibly and free of charge.

4.2. Entry and exit procedure: Entry and the placement of vehicles in the Parking Facility are carried out manually under the personal direction of the on-site professional staff.

4.3. Parking spaces and surface: The outdoor parking area has a gravel surface. Parking spaces are separated by surface markings and numbering. The Passenger must park the vehicle in the designated space and drive carefully in accordance with the road conditions.

4.4. Storage of ignition keys: At the start of parking, the Passenger hands over the vehicle's ignition key to the Operator for safekeeping. The Operator stores the keys in a locked, secure key cabinet. By handing over the key, the Passenger expressly consents to the staff moving the vehicle within the parking facility in the event of a technical fault, fire or emergency, or an operational rearrangement of the parking facility.

4.5. Record and handover: The staff and the Passenger may complete a handover record/document concerning the handover of the vehicle and the keys. The Operator releases the vehicle to the person presenting the parking receipt or to the person authorised to exercise control over the vehicle. In case of doubt, the Operator may request action by the authorities.

4.6. Flight tracking and delays: The Passenger must provide the flight number and expected arrival time of their return flight. If the aircraft is delayed by at least 30 minutes according to official data (e.g. Flightradar24), the Operator is entitled to arrange the arrival time of the transfer vehicle according to operational possibilities. The Operator assumes no liability for compensation for any waiting time resulting from this.

4.7. Force Majeure: In the event of a strike, exceptional weather conditions, traffic blockade, or other force majeure event, the Operator is released from the obligation to perform at the exact scheduled time.

5. Obligations of the Operator and Limitation of Liability

5.1. In accordance with the selected package, the Operator stores the vehicle in a guarded outdoor parking area or in an enclosed, heated and cooled garage.

5.2. Exclusions of liability:

  • In the case of outdoor parking: The Operator assumes no liability for damage caused by natural environmental effects (dust, leaves, bird droppings) or exceptional weather events (storms, hail, lightning strikes).
  • Valuables: The Operator assumes no liability for personal belongings, electronic devices, cash, or navigation devices left by the Passenger in the passenger compartment or luggage compartment.
  • Damage caused by third parties: The Operator is not liable for minor collisions, door impacts, or scratches caused by other users of the parking facility, but supports official proceedings by providing camera footage and data.
  • Technical faults: The Operator is not liable for technical failures arising from the vehicle itself (flat battery, puncture, starter motor fault).

5.3. Prohibited materials: No dangerous, flammable, explosive, toxic, perishable, or illegal material, or live animal, may be left in the parked vehicle. In the event of a breach, the Operator will notify the authorities and charge the Passenger for any resulting damage.

5.4. Reporting damage: The Passenger must report any damage to the vehicle to the staff on site and have it recorded in a report exclusively before leaving the Parking Facility. No subsequent claim for damages may be made after leaving the Parking Facility.

5.5. Exceeded parking period: If the Passenger exceeds the booked period, the Operator is entitled, as a usage fee, to twice the current basic daily parking fee for each commenced day after expiry.

6. Rules of the Transfer Service and Luggage Transport

6.1. Rights of the Passenger during the transfer:

  • Travel in a clean, roadworthy vehicle with valid permits;
  • A courteous driver who complies with traffic regulations;
  • The right to request appropriate heating or air conditioning;
  • A smoke-free passenger compartment.

6.2. Conduct of the driver: The driver must behave courteously and helpfully. The driver may not initiate overly familiar conversations on political, religious, or private-life matters, must respect the Passenger's privacy, and must handle any information that comes to their knowledge discreetly.

6.3. Transport of luggage:

  • As a general rule, 1 item of hand luggage and 1 standard-size checked suitcase may be transported per Passenger.
  • No item may be transported if, due to its size, it does not fit, may soil or damage the vehicle, or endangers the physical safety of passengers.
  • The transport of oversized luggage (ski equipment, bicycle, etc.) or a live animal constitutes a special request and may only be provided by prior arrangement and in a closed carrier.

6.4. Damage caused by the Passenger: The Passenger must reimburse the costs of any permanent soiling or damage caused by the Passenger in the transfer vehicle or the garage.

7. CANCELLATION CONDITIONS AND CANCELLATION FEE (Removable standalone chapter)

7.1. The Passenger is entitled to withdraw from the contract before the commencement of the Service.

7.2. If the Passenger notifies the Operator of their intention to cancel within the following time windows before the booked time, the Operator is entitled to the following cancellation fee:

  • Cancellation more than 72 hours in advance: Free of charge (100% of the amount paid will be refunded).
  • Cancellation between 72 and 48 hours in advance: The Operator is entitled to 50% of the parking fee as a cancellation fee.
  • Cancellation between 48 and 24 hours in advance: The Operator is entitled to 75% of the parking fee as a cancellation fee.
  • Cancellation within 24 hours or failure to appear (No-Show): The Operator is entitled to 100% of the parking fee as a cancellation fee.

7.3. If the Service cannot be performed for a reason attributable to the Operator, 100% of the fee paid will be refunded.

8. Additional and Supplementary Services

8.1. Subsequent delivery of items left in the vehicle: At the Passenger's request, the fee for delivering items left in the parked vehicle to the airport is: HUF 3,500 / occasion.

8.2. Battery starting (jump-starting): Starting a flat battery from an external power source: HUF 3,000.

8.3. Puncture handling: If a tyre of the vehicle becomes flat, with the Passenger's prior consent the Operator may arrange for the wheel to be removed and repaired, for an organisational base fee of HUF 5,000 plus the actual tyre service costs incurred.

9. Complaint Handling and Enforcement of Rights

9.1. The Passenger may submit complaints relating to the Service verbally on site or in writing to the Operator's e-mail address.

9.2. In the event of a consumer dispute, the Passenger may contact the territorially competent Conciliation Board or Consumer Protection Authority:

10. Final Provisions

10.1. Matters not regulated in these GTC shall be governed by Act V of 2013 on the Civil Code, Government Decree 176/2015 (VII. 7.) on passenger transport by passenger car for consideration, and the applicable consumer protection and data protection (GDPR) legislation of the European Union and Hungary.

10.2. The Operator is entitled to amend the GTC unilaterally, provided that bookings already concluded remain subject to the conditions in force at the time of booking.
